Terms of Use

Part 1 – Background, Purpose and Permitted Users

 

This is www.jointpro.co.uk a website ("the Website") owned and operated by Imperial College of Science, Technology and Medicine, a charity and UK institution of Higher Education constituted by Royal Charter (with registered number RC000231) of Exhibition Road, London, SW7 2AZ ("Imperial College").   References to "we", "us" and "our" in these terms refer to Imperial College.

 

Please read these terms of use carefully before you start to use the Website. By using the Website, you confirm that you accept these terms of use (Including this Part 1, the relevant set of Specific User Terms in Part 2 and General Terms of Use in Part 3) and that you agree to comply with them.  We recommend that you print and retain a copy of these terms for future reference.

 

By using the Website you also agree to our Privacy Policy, which sets out the terms on which we process any personal data we collect from you or that you provide to us in the course of your use of the Website.  The Privacy Policy also includes our Cookies Policy.

 

If you do not agree to these terms of use, or the Privacy Policy, you must not use the Website.

 

The primary purpose of the Website is to provide a resource to enable individuals with long-standing persistent hip, knee and/or shoulder pain to record information relating to their condition, treatment and recovery and (in line with our Privacy Policy) share such information with:

 

  • selected health care professionals (including their doctors, their physiotherapists and members of their doctors' and physiotherapists' clinical teams); 
  • Imperial College researchers;
  • (where applicable to the Patient’s case and approved by the Patient) other academic researchers
  • (where applicable to the Patient’s case and approved by the Patient) staff employed or engaged by the Patients’ healthcare provider, for the purpose of clinical audits for the relevant hospital site or surgical unit, and submissions to relevant regulatory bodies (such as PHIN or NHS Digital)and or
  • (in certain cases) the relevant national records system that monitors all admissions, appointments and attendances at NHS hospitals (and/or private hospitals, as applicable). 

 

The Website is therefore only intended for use by the following types of user:

  • patients with long-standing persistent hip, knee and/or shoulder problems ("Patients");
  • GPs and Consultants registered with the UK General Medical Council ("Doctors") and Physiotherapists registered with the Health & Care Professions Council ("Responsible Care Providers"), or other Health Care Professionals who are members of a clinical team associated with Responsible Care Providers ("Other Clinical Team Members" – defined in more detail in Part 2); 
  • academic researchers of Imperial College (“Imperial College Researchers”);
  • academic researchers of institutions other than Imperial College ("Academic Researchers") working on a clinical study which: (i) uses the Website to capture clinical research data and (ii) has been officially registered as such (a "Registered Study"); and
  • managers and senior administrative staff employed or engaged by a healthcare provider, for the purpose of clinical audits and submissions to relevant regulatory bodies (“Healthcare Analysts”), whose use of the Website has been approved by the Website’s administrators; and where Patients have approved access to their clinical information for such purpose by way of entering a site-specific code.

 

By seeking to register a user Account on the Website ("a JointPRO Account") you confirm that you fall within one of the above categories of permitted user.  You also confirm that you agree to the specific set of user terms applicable to you, as shown in Part 2 of these terms (Specific User Terms).  

 

These are:

  • specific terms for Patients 
  • specific terms for Responsible Care Providers (GPs, Consultants and Physiotherapists)
  • specific terms for Other Clinical Team Members 
  • specific terms for Imperial College Researchers 
  • specific terms for Academic Researchers
  • specific terms for Healthcare Analysts

 

Part 2 – Specific User Terms.

 

In addition to the introductory terms in Part 1 above and the General Terms of Use in Part 3 below (which will both apply to all users of the site), the following additional specific terms apply to the different categories of user of the Website.

2.1    Patients:

  • Activation and access to your JointPRO Account is conditional upon you completing the relevant information and account verification steps, as shown on the Website, and receiving an acceptance email from us notifying you of successful activation.
  • To open and to maintain access to your JointPRO Account you are required to fill in a number of fields relating to your personal information and details of your condition, and update this information from to time to time in line with the requirements published on the Website.  We reserve to suspend or remove access to your JointPRO Account where you do not update your JointPRO Account information in line with the published minimum information requirements. 
  • Once activated, your JointPRO Account is made available to you to allow you to upload and monitor information relating to your medical condition through the Website and share that information with Responsible Care Providers (GPs, Consultants and Physiotherapists) and Other Clinical Team Members involved in your care, and - where you have approved such access via your privacy preferences - Academic Researchers and/or Healthcare Analysts. Once activated, your JointPRO Account is also made available to Imperial College Researchers in pseudonymised form (that is, a form in which your data will be categorised by way of a specific numeric/code-based Patient ID rather than by your name).
  • You will be asked to complete questionnaires on the Website.  All information uploaded by you (including any form data) must be truthful and accurate, and compliant with our other rules around uploading content on the Website contained in our General User Terms in Part 3 below.
  • You acknowledge that we may process your personal data, including any information you complete on the Website relating to your condition and treatment and other personal medical information, in line with the Privacy Policy and in accordance with any approvals relating to access given by you at the point that information is uploaded (as updated by you from time to time).
  • You acknowledge that any information you upload relating to your condition may be used and reproduced by us in aggregated or anonymised form (that is, a form which does not allow the information to be linked to you personally).  Such use might include sale or licensing of the aggregated data-set we create via the Website for commercial purposes (for example to manufacturers of implants or prosthetics) although we would normally only do so where such use or exploitation had the potential for improving the health and wellbeing of patients.
  • You understand that the terms and conditions in these Specific User Terms apply in addition to the introductory terms in Part 1 above and the General Terms of Use in Part 3 below, which also apply to your use of the Website.

 

2.2    Responsible Care Providers (GPs, Consultants and Physiotherapists):

  • The activation of your JointPRO Account is subject to us verifying that you are either a Doctor registered with the General Medical Council ("GMC") in the UK or a Physiotherapist registered with the Health & Care Professions Council ("HCPC") in the UK.   We normally do this by requesting access to a copy of your GMC or HCPC certificate although we constantly monitor and seek to improve our verification processes and this process may change from time to time.  Your Account will not be activated until such verification is complete.  
  • By registering for the Website and setting up a JointPRO Account you will not have any automatic right to review any Patient's clinical profile.  Access will be granted only where a Patient has approved this.  Patients have a right to vary the how their personal information is used from time to time and may therefore remove your access to their clinical profile.
  • Once your JointPRO Account is activated, you will be able to generate your own "Patient List".  This is a list of Patients who have given their approval to you reviewing their clinical profile, either because you are one of their Responsible Care Providers, or you work in the same medical practice as one of their Responsible Care Providers.  
  • You will not have any rights to edit or input into a Patient's clinical profile with the exception of details of the Patient's basic information (including their date of birth and address) and their medical condition or procedure for the purpose of ensuring that this information is accurate and up to date.
  • Where a Patient approves your access to his/her clinical profile, this is to enable you to monitor and assess his/her condition and treatment options and you should not use the information provided, or the Website, for any other purpose.
  • We expect you to exercise the utmost professional and personal integrity when using the website and will have the right to suspend or terminate (in our sole discretion) your access to any Patient's clinical profile or part or all of the Website at any time for breach of the obligations in these terms of use or for any other reason without incurring any liability to you.
  • Where a Patient has approved access to this (as will be apparent from a Patient's privacy preferences from time to time), his/her clinical profile may also be made available to other healthcare professionals in your team ("Other Clinical Team Members" – defined in more detail below) who are assisting you with the Patient's care.   A list of the categories of healthcare professionals who might be included as Other Clinical Team Members is set out at section 2.3 of the Other Clinical Team Members Specific User Terms below.
  • Information contained on a Patient's clinical profile and the fact that the Patient has a JointPRO Account is confidential information and special category data and you must keep such information confidential and hold and use it securely in accordance with the requirements of the Data Protection Act 2018, the General Data Protection Regulation and all applicable guidelines relating to the storage and use of patient confidential information, including Confidentiality: NHS Code of Practice and the GMC's guidance on Confidentiality. You will also use your best endeavours to ensure the compliance by Other Clinical Team Members who have access to Patients' clinical profiles via your Patient List maintain the confidentiality of the information and comply with such requirements.
  • You are expected to regularly review the list of Other Clinical Team Members who have been granted access to your Patient List and must notify us immediately if any such Other Clinical Team Member leaves your practice or staff (as applicable).
  • You agree to indemnify (that is, protect and reimburse) and keep indemnified Imperial College in relation to costs and liabilities incurred arising directly from any claims (actual or threatened) or fines made against Imperial College arising from your breach of these Specific User Terms in this section 2.2.
  • You must notify us immediately by email to admin@jointpro.co.uk if you become aware of any breach of confidentiality or loss of data relating to a Patient's clinical profile.
  • Where you change your place of work or retire, or a Patient(s) leaves your care, you should notify the relevant Patient(s) on your Patient List who will (following such change) no longer be in your care and ask the Patient to remove your access to their clinical profile (unless the Patient agrees that he/she is happy for such access to continue).
  • You must either notify us immediately or reject or cancel any invite from a Patient to view his/her clinical profile where it is clear that a Patient has invited you or provided you access to their clinical profile in error (for example, where they are clearly not one of your patients).
  • You understand that the terms and conditions in these Specific User Terms apply in addition to the introductory terms in Part 1 above and the General Terms of Use in Part 3 below, which also apply to your use of the Website.

 

2.3    Other Clinical Team Members:

 

  • As an Other Clinical Team Member your role will fall into one of the following categories:
    • For Primary Care (ie a GP practice):
      • Practice Nurse
      • Various other positions relevant to a Patient's care
    • For Secondary Care (ie a hospital):
      • Specialist Trainee (Registrar)
      • Staff Grade Core Trainee (SHO)
      • Clinical Nurse Specialist
      • Various other positions relevant to a Patient's care
  • By registering for the Website and setting up a JointPRO Account you will not have any automatic right to review any Patient's clinical profile.  Access will be granted only where a Patient has approved this.
  • The activation of your JointPRO Account is subject to us verifying that you are either a Nurse registered with the Nursing and Midwifery Council ("NMC") in the UK or a Doctor registered with the General Medical Council ("GMC") in the UK.  We normally do this by requesting access to a copy of your NMC or GMC certificate although we constantly monitor and seek to improve our verification process and this process may change from time to time. Your Account will not be activated until such verification is complete.
  • You will not have any rights to edit or input into a Patient's clinical profile with the exception of details of the Patient's basic information (including their date of birth and address) and their medical condition or procedure for the purpose of ensuring that this information is accurate and up to date.
  • Where a Patient approves your access to his/her clinical profile, this is to enable you to monitor and assess his/her condition and treatment options and you should not use the information provided, or the Website, for any other purpose.
  • We expect you to exercise the utmost professional and personal integrity when using the Website and will have the right to suspend or terminate (in our sole discretion) your access to any Patient's clinical profile or part or all of the Website at any time for breach of the obligations in these terms of use or for any other reason without incurring any liability to you.
  • Information contained on a Patient's clinical profile and the fact that the Patient has a JointPRO Account is confidential information and special category data and you must keep such information confidential and hold and use it securely in accordance with the requirements of the Data Protection Act 2018 and the General Data Protection Regulation and all applicable guidelines relating to the storage and use of patient confidential information, including Confidentiality: NHS Code of Practice and the GMC's guidance on Confidentiality.  
  • You agree to indemnify (that is, protect and reimburse) and keep indemnified Imperial College in relation to costs and liabilities incurred arising directly from any claims (actual or threatened) or fines made against Imperial College arising from your breach of these Specific User Terms in this section 2.3.
  • You must notify us immediately by email to admin@jointpro.co.uk if you become aware of any breach of confidentiality or loss of data relating to a Patient's clinical profile.
  • Where you change your place of work or retire, or a Patient(s) leaves your care, you should notify the relevant Patient(s) on your Patient List who will (following such change) no longer be in your care and ask the Patient to remove your access to their clinical profile (unless the Patient agrees that he/she is happy for such access to continue).
  • You must either notify us immediately or reject or cancel any invite from a Patient to view his/her clinical profile where it is clear that a Patient has invited you or provided you access to their clinical profile in error (for example, where they are clearly not one of your patients).
  • You understand that the terms and conditions in these Specific User Terms apply in addition to the introductory terms in Part 1 above and the General Terms of Use in Part 3 below, which also apply to your use of the Website.

 

2.4    Imperial College Researchers

  • The activation of your JointPRO Account is subject to us verifying that you have an existing employment or honorary contract with Imperial College.  Your Account will not be activated until such verification is complete.
  • By registering for the Website and setting up a JointPRO Account you will not have any automatic right to review any Patient's clinical profile.  Access will be granted only if the Patient has approved access by Imperial College researchers.  Patients have a right to close their JointPRO Account at any time which will therefore remove your access to their clinical profile.
  • You will not have any right to edit or upload information in relation to a Patient's clinical profile with the exception of editing basic information (including their date of birth and address) and their medical condition or procedure for the purposes of ensuring that such information is accurate and up to date.
  • We expect you to exercise the utmost ethical and personal integrity when using the Website and will have the right to suspend or terminate (in our sole discretion) your access to any Patient's clinical profile or part or all of the Website at any time for breach of the obligations in these terms of use or for any other reason without incurring any liability to you.
  • You are only permitted to use the Website and the data in connection with your work at Imperial College.
  • Information contained on a Patient's clinical profile and the fact that the Patient has a JointPRO Account is confidential information and special category data and you must keep such information confidential and hold and use it securely in accordance with the requirements of the Data Protection Act 2018, the General Data Protection Regulation and all applicable guidelines relating to the storage and use of patient confidential information, including Confidentiality: NHS Code of Practice and as set by Imperial College's ethics committee.  
  • You must notify us immediately by email to admin@jointpro.co.uk if you become aware of any breach of confidentiality or loss of data relating to a Patient's clinical profile.
  • You must notify admin@jointpro.co.uk immediately if your contract with Imperial College ends.  
  • You understand that the terms and conditions in these Specific User Terms apply in addition to the introductory terms in Part 1 above General Terms of Use in Part 3 below, which also apply to your use of the Website.

 

 2.5    Academic Researchers

 

  • Access to a JointPRO Account is only available to Academic Researchers working on a clinical study which: (i) uses the Website to capture clinical data (ii) has obtained Research Ethics Committee approval and (iii) has been officially registered as such (a "registered study").  We will have complete discretion as to whether to allow a study to register on the Website.
  • The activation of your JointPRO Account is subject to us receiving verification of your Account from the Lead Investigator for the registered study, or, if you are a Lead Investigator, approval of the Website's super-administrator.  Your Account will not be activated until such verification is complete.  
  • By registering for the Website and setting up a JointPRO Account you will not have any automatic right to review any Patient's clinical profile.  Access will be granted only where a Patient involved in the registered study has approved this.  Patients have a right to vary the terms of approval from time to time and may therefore remove your access to their clinical profile.
  • We expect you to exercise the utmost ethical and personal integrity when using the Website and will have the right to suspend or terminate (in our sole discretion) your access to any Patient's clinical profile or part or all of the Website at any time for breach of the obligations in these terms of use or for any other reason without incurring any liability to you. 
  • Information contained on a Patient's clinical profile and the fact that the Patient has a JointPRO Account is confidential information and special category data and you must keep such information confidential and hold and use it securely in accordance with the requirements of the Data Protection Act 2018, the General Data Protection Regulation and all applicable guidelines relating to the storage and use of patient confidential information, including Confidentiality: NHS Code of Practice and as set by your institution's ethics committee.  
  • Each Lead Investigator will use their best endeavours to ensure that Academic Researchers who are working on the approved research study who have access to Patients' clinical profiles maintain the confidentiality of the information and comply with such requirements.
  • You agree to indemnify (that is, protect and reimburse) and keep indemnified Imperial College in relation to costs and liabilities incurred arising directly from any claims (actual or threatened) or fines made against Imperial College arising from your breach of these Specific User Terms in this section 2.5.
  • You must notify us immediately by email to admin@jointpro.co.uk if you become aware of any breach of confidentiality or loss of data relating to a Patient's clinical profile.
  • If you are a Lead Investigator for a registered study, you are expected to regularly review the list of Academic Researchers who have been granted access to the clinical profiles of Patients on the registered study and you must notify us immediately if any such Academic Researchers ceases to work on the registered study.  You must also keep any key or code which may be used to decrypt pseudonymised data private, safe and secure and not share this with any other person.
  • You must either notify us immediately or reject or cancel any invite from a Patient to view his/her clinical profile where it is clear that a Patient has invited you or provided you access to their clinical profile in error (for example, where the Patient is not registered on the relevant registered study).
  • We may suspend or cancel access to your JointPRO Account where you cease to work on a registered study.
  • You understand that the terms and conditions in these Specific User Terms apply in addition to the introductory terms in Part 1 above and the General Terms of Use in Part 3 below, which also apply to your use of the Website.

 

2.6  Healthcare Analyst

 

  • Access to a JointPRO Account is only available to authorised Healthcare Analysts working at a hospital or other clinical unit which has been allocated a specific research code by the Website administrator (Clinical Facility).  We will have complete discretion as to whether to allow a site to register on the Website.
  • The activation of your JointPRO Account is subject to us receiving verification of your Account from a Facility Coordinator” for your Clinical Facility, or, if you are a Facility Coordinator, approval of the Website's super-administrator.  Your Account will not be activated until such verification is complete.  
  • By registering for the Website and setting up a JointPRO Account you will not have any automatic right to review any Patient's clinical profile.  Access will be granted only where a Patient has approved access by Healthcare Analysts at your Clinical Facility.  Patients have a right to vary the terms of approval from time to time and may therefore remove your access to their clinical profile.
  • We expect you to exercise the utmost ethical and personal integrity when using the Website and will have the right to suspend or terminate (in our sole discretion) your access to any Patient's clinical profile or part or all of the Website at any time for breach of the obligations in these terms of use or for any other reason without incurring any liability to you. 
  • Information contained on a Patient's clinical profile and the fact that the Patient has a JointPRO Account is confidential information and special category data and you must keep such information confidential and hold and use it securely in accordance with the requirements of the Data Protection Act 2018, the General Data Protection Regulation and all applicable guidelines relating to the storage and use of patient confidential information.
  • Each Facility Coordinator will use their best endeavours to ensure that Healthcare Analyst who are working on the approved research study who have access to Patients' clinical profiles maintain the confidentiality of the information and comply with such requirements.
  • You agree to indemnify (that is, protect and reimburse) and keep indemnified Imperial College in relation to costs and liabilities incurred arising directly from any claims (actual or threatened) or fines made against Imperial College arising from your breach of these Specific User Terms in this section 2.6.
  • You must notify us immediately by email to admin@jointpro.co.uk if you become aware of any breach of confidentiality or loss of data relating to a Patient's clinical profile.
  • If you are a Facility Coordinator for a registered study, you are expected to regularly review the list of Healthcare Analysts who have been granted access to the clinical profiles of Patients on the registered study and you must notify us immediately if any such Healthcare Analyst ceases to work on the registered study.  You must also keep any key or code which may be used to decrypt pseudonymised data private, safe and secure and not share this with any other person.
  • You must either notify us immediately or reject or cancel any invite from a Patient to view his/her clinical profile where it is clear that a Patient has provided you access to their clinical profile in error (for example, where the Patient is not a patient of the Clinical Facility).
  • We may suspend or cancel access to your JointPRO Account where you cease to work at or for the Clinical Facility.
  • You understand that the terms and conditions in these Specific User Terms apply in addition to the introductory terms in Part 1 above and the General Terms of Use in Part 3 below, which also apply to your use of the Website.

 

 

Part 3 – General Terms of Use – applicable to all users of the Website

 

3.1    Accessing the Website 

 

The Website and any JointPRO Accounts are made available free of charge.

 

We do not guarantee that the Website, or any content on it, or JointPRO Accounts will always be available or be uninterrupted.  Access to the Website site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of the Website without notice, including your JointPRO Account.  We will not be liable to you if for any reason the Website and/or your JointPRO Account is unavailable at any time or for any period.

 

You are responsible for making all arrangements necessary for you to have access to the Website.  

 

For Patients, Doctors, Physiotherapists, Other Clinical Team Members, Imperial Researchers and Academic Researchers additional rules apply in relation to your access to the Website.  These are shown in Part 2 (Specific User Terms).  

 

3.2  Adding a patient 

 

If you are using the ‘add a patient’ feature on the Website you must have the patient’s prior approval before doing so. 

 

If you are the carer or family member of a patient registering on behalf of a patient you may register with JointPRO and complete the questionnaire on the patient’s behalf, as long as the patient is present.

 

3.3 Your account and password

 

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party. 

 

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

 

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at admin@jointpro.co.uk

 

3.4    Intellectual Property Rights

 

We are the owner or the licensee of all intellectual property rights in the Website, and in the material published on it, including (without limitation):

  • the novel joint-specific PROs questionnaire relating to patient’s personal aspirations to determine the outcome of an intervention; 
  • the databases and data sets created via the Website.

 

Those works are protected by copyright and other intellectual property rights.  All such rights are reserved. 

 

You grant us a perpetual, irrevocable, royalty-free, worldwide licence (including the right to sub-license) to use and reproduce any information or material you post on the Website for any purpose and in any form of media.   Where that information constitutes personal data, our use of such data will be consistent with the terms of our Privacy Policy.

 

You may print off one copy, and may download extracts, of any page(s) from the Website for your personal use and you may draw the attention of others within your organisation to content posted on the Website.  

 

You must not use or reproduce any part of the content on the Website for commercial purposes without obtaining a licence to do so from us and/or our licensors.   

 

If you print off, copy or download any part of the Website in breach of these terms of use, your right to use the Website will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

 

3.5    No reliance on information

 

The content on the Website is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on the Website.

 

Although we make reasonable efforts to update the information on the Website, we make no representations, warranties or guarantees, whether express or implied, that the content on the Website is accurate, complete or up-to-date. 

 

3.6    Limitation of Imperial College's liability

 

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

 

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the Website or any content on it, whether express or implied. 

 

We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

 

•    use of, or inability to use, the Website or any part of it (including your JointPRO Account); or

•    use of or reliance on any content displayed on the Website. 

 

You agree not to use the Website for any commercial or business purposes, except as expressly permitted on the site, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

 

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Website or to your downloading of any content on it, or on any Website linked to it.

 

We assume no responsibility for the content of Websites linked on the Website. Such links should not be interpreted as endorsement by us of those linked Websites. We will not be liable for any loss or damage that may arise from your use of them.

 

3.7    Uploading content to the Website

 

You agree not to use this Website:

  • to create a database (electronic or otherwise) that includes material downloaded or otherwise obtained from the Website, except where expressly permitted on the Website; 
  • to disseminate advertisements or for any other commercial purposes (which would include using the Website to promote or encourage the sale of your goods/services);
  • to transmit or re-circulate any material obtained from this Website except where expressly permitted on this Website; 
  • to disseminate any unsolicited or unauthorised advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation; 
  • to disseminate any material which is abusive, defamatory or obscene, may harass, offend or inconvenience any person, applauds, encourages or entices abuse, discrimination or criminal activity or which might restrict or inhibit the use and enjoyment of the Website by any person;
  • to disseminate any material that contains software viruses or any other computer code, files or programs designed to interrupt, damage, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; 
  • in any way that might infringe third party privacy or intellectual property rights, is unlawful or that does or might damage the reputation of Imperial College; or
